No one is present on behalf of the applicant. 2. Vakalatnama filed on behalf of opposite party no. 2 by Shri Amitesh Pratap Singh, Advocate is taken on record. 3. On 22.08.2025, this Court had passed the following order: "1. Heard learned cousnel for the applicant, learned A.G.A. for the State and perused the records. 2. Instant application has been filed with the prayer to quash the impugned chargesheet dated 24.06.2019, summoning order dated 26.10.2019 and all subsequent criminal proceedings arising out of the same in Criminal Case no. 1743 of 2019 airing out of F.I.R. No. 0077 of 2019 under sections- 323, 427, 504 and 506 of IPC P.S.- Bhiti District- Ambedkar Nagar. 3. It is argued by counsel for the applicant that the matter is arising out of matrimonial dispute as the applicant being the husband, was called for settlement, but some altercation took place and the first information report is lodged. She added that there is still possibility of amicable settlement in between the parties, therefore, the matter may be referred to the mediation and conciliation centre of this Court. 4. The State Counsel though, has opposed the contentions aforesaid on merits, but he has no objection if the parties are ready to settle their dispute. 5. For the for going reasons, the complainant is directed to remain present before this Court on 08.09.2025 at 2:15 pm, so as to record his statement, regarding the settlement between the parties. 6. The applicant shall fetch a demand draft of Rs. 25,000/- in favour of opposite party no. 2 on the date fixed. 7. List/put up this matter on 08.09.2025 at 2:15 pm. 8. Till the next date of listing, the criminal proceedings of Criminal Case no. 1743 of 2019 airing out of F.I.R. No. 0077 of 2019 under sections- 323, 427, 504 and 506 of Versus Counsel for Applicant(s) : Km. Deepa, Manjari Singh, Vikrant Prakash Counsel for Opposite Party(s) : G.A. Shushil Kumar Singh Alias Shushil Singh .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another .....Opposite Party(s) IPC P.S.- Bhiti District- Ambedkar Nagar shall remain stayed, so far as the present applicant is concerned." 4. Neither counsel for the applicant is present nor any receipt with respect to preparing demand-draft of Rs.25,000/- is placed before this Court. It seems that the applicant is playing with the Court and, therefore, the order dated 22.08.2025, staying the criminal proceedings, is hereby recalled and the application is dismissed for want of prosecution. 5.
