1. The instant review petition has been preferred for recalling of the order dated 17.03.2023 passed by this Court while deciding S.B. Civil Writ Petition No.2748/2016 on 17.03.2023, whereby, the petition submitted by the petitioner was dismissed on the ground that he had concealed and suppressed the pendency of criminal case against him. 2. Counsel for the petitioner submits that when the matter was listed before this Court on 17.03.2023, the court work was
[2025:RJ-JP:10298] (2 of 2) [WRW-88/2023] suspended. Counsel submits that the petitioner was unable to explain the factual aspect of the matter, that at the time of submitting the application form, no criminal case was registered against the petitioner and the counsel submits that only a preliminary enquiry was pending and the petitioner was unaware about the same. Hence, under these circumstances, the order dated 17.03.2023 passed by this Court be recalled. 3. Per contra, learned counsel for the respondent-State opposes the arguments raised by the counsel for the petitioner and submits that a criminal case was, in fact, pending against the petitioner and this fact was concealed and suppressed by him, hence, under these circumstances, this Court has rightly passed the order dated 17.03.2023, dismissing the writ petition of the petitioner on this count alone. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. Looking to the fact that a preliminary enquiry was pending, pursuant to the complaint No.144/2012, but no FIR was registered against the petitioner till 26.08.2014, and this fact was not brought into the notice of this Court at the time of arguments on 17.03.2023 by either side, hence, under these circumstances, the aforesaid order was passed by this Court. 6. Application stands allowed for the reasons stated therein. 7.
The order dated 17.03.2023 stands recalled and the S.B. Civil Writ Petition No.2748/2016 is restored to its original number. (ANOOP KUMAR DHAND),J GARIMA /83
