Neutral Citation No. - 2025:AHC-LKO:9121 Court No. - 7 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 9579 of 2024 Applicant :- Imran @ Ibran Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko Counsel for Applicant :- Bal Krishna Shukla Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.
2. It is argued by the counsel for the applicant that co-accused was enlarged on bail vide order dated 19.06.2024 passed in Criminal Misc. Bail Application No. 5603 of 2024. He further argued that the applicant is languishing in jail since 22.02.2024 having no criminal history, as such, he may be enlarged on bail.
3. The counsel for the applicant does not claim parity with the co-accused, however, the documents on record reveals that the charge sheet has been filed.
4. Learned A.G.A. opposed the bail prayer but could not dispute the aforesaid fact.
5. Considering the fact that the charge sheet has been filed and there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial and without expressing any opinion on merit, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed.
6. Let the applicant Imran @ Ibran be released on bail in FIR/ Case Crime No. 29 of 2024, under
