Mr. Dharmendra Barthwal, Advocate for respondent no. 5. 4. Petitioners are retired employees of Uttarakhand Power Corporation Limited. They applied for commutation of pension. According to them, full pension is being restored to retired employees who applied for commutation of pension only upon completion of 15 years; while, the full pension should be restored after 10 years and 8 months. The reliefs sought in the writ petition are as follows: - “I. Issue writ, rule or direction in nature of mandamus by directing the respondents to allow the benefit of full pension after completion of 12 years of service and to along with all consequential benefit and also to declare the fixing 15 years period for commutation of pension as arbitrary irrational and unjust and to quashed the same along with its effect and operation also after calling the entire record for the respondents or to mould appropriately relief by safeguarding interest of the petitioners keeping in view fact of body of the petition the facts highlighted in the body of the petition. II. Issue writ rule or direction in the nature of mandamus by directing the respondents to restore the full pension of the petitioners after the period of 10 years 8 month 2025:UHC:11543 from the date of retirement along with all consequential benefits by refixation of their pension or to mould appropriately relief by safeguarding interest of the petitioners keeping in view fact of body of the petition the facts highlighted in the body of the petition.” 5. Learned counsel for the petitioners submits that joint representation is made by all the petitioners, which is pending consideration before the Secretary, Energy. He prays that the writ petition be disposed of asking the Secretary, Energy to take decision on the pending representation. 6. The writ petition is, accordingly, disposed of with a direction to the Secretary, Energy, Government of Uttarakhand to take decision on the representation made by the petitioners (Annexure-2 to the writ petition), as per law, within six months from the date of presentation of certified copy of this order.
