This is first bail application seeking grant of bail to the Applicant who is in jail since 30.09.2023 in connection with Crime No.759/2023 registered at Police Station Kotwali, District Rajnandgaon, for the offence punishable under Section 302 IPC. 2. As per prosecution case, the wife of applicant namely Roshni Meshram was found dead inside the house of applicant on 27.09.2023 at 11:15 AM. Her dead body was inside the house of applicant in injured condition. On postmortem, it was opined that deceased died due to strangulation. Learned Counsel for the applicant would submit that on a sudden quarrel and heat of passion there was quarrel between the husband and wife by which he pushed her and she received injury from the door and fell down on the ground. He has not committed any offence with her. Final adjudication of case will take its time and therefore he may be enlarged on bail. 4. On the other hand the counsel for the State opposes the bail application and have submitted that dead body of the deceased who is wife of applicant was found inside the house of appellant. The doctor who conducted postmortem has opined that death of deceased was due to strangulation and it was homicidal in nature, therefore, the appellant do not deserve to be released on bail. 5. Without commenting on merits, considering the totality of the facts and circumstances of the case, considering the nature of allegation and the fact that applicant failed to explain how his wife was found dead inside his house in an injured condition, further as per the postmortem report the deceased died due to strangulation and death to be homicidal in nature, this Court is of the opinion that present is not a fit case where the Applicant can be enlarged on bail. 6.
