JUSTICE ARUN KUMAR JHA ORAL ORDER 4 17-02-2025 Heard learned counsel for the petitioners as well as learned senior counsel for the respondents. 2. After some argument, both sides agree that in the interest of parties it would be beneficial that Title Appeal No. 39 of 2011 is disposed of by the learned first appellate court at the earliest so that right and interest of all the parties are safeguarded. Learned counsels for the parties pray for directing the learned first appellate court for early disposal of Title Appeal No. 39 of 2011 and within some stipulated time. 3. Learned counsel appearing on behalf of the petitioners submits that till disposal of Title Appeal No. 39 of 2011, the interest of the petitioners be protected to the extent of their purchased property. 4. Under the aforesaid circumstances, learned first appellate court is directed to dispose of Title Appeal No. 39 of 2011 at the earliest and within a period of one month from the date of receipt/production of a copy of this order considering the fact that the appeal is pending for more than 14 years. Till disposal of Title Appeal No. 39 of 2011, the execution proceeding against the property purchased and claimed by the petitioners shall remain stayed.
