Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 4920 of 2025 Petitioner :- Nabi Sher Khan Respondent :- Mohd. Umar Counsel for Petitioner :- Suresh Chand Rathour Counsel for Respondent :- Rakesh Kumar Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the petitioner and Shri Rakesh Kumar and Shri Prateek Dixit, learned counsel for the respondent.
2. The present petition has been filed by the petitioner challenging the order passed by the JSC Court, whereby a decree of rent and ejectment was passed in favour of the land lord on 16.08.2023 as well as the revisional order dated 02.08.2025, whereby the revision was dismissed.
3. The facts as emerge are that the respondent-land lord served a notice and thereafter instituted proceedings alleging that there was a default of rent. The petitioner herein took a stand that he had paid an amount of Rs.3,90,000/- and it was orally agreed that the shop in question shall be sold in his favour. The said defence was not accepted by the trial court as well as the revisional court as prima facie no evidence could be produced. Both the courts have recorded concurrent findings with regard to default in payment of rent.
4. The concurrent findings of fact cannot be interfered in exercise of powers under Article 226 of the Constitution of India.
5. The petition lacks merits and is, accordingly, dismissed. Order Date :- 20.8.2025 Ashutosh Digitally signed by :- ASHUTOSH PANDEY High Court of Judicature at Allahabad, Lucknow Bench
