This is an application filed under Section 151 CPC for a direction to release deposited amount in favour of the applicants. Learned counsel for the applicant has submitted that since the appeal has been disposed of, the deposited amount of compensation be released in respect of proportionate share of the claimant-applicants except the share of Miss Debjani Barman, applicant No. 2 herein, as she is minor. I have gone through the application and the contentions made therein are found to be satisfactory. Accordingly, the applicants are permitted to withdraw the deposited amount of compensation as per their share. It is clarified that the share of applicant No.2, Miss Debjani Barman shall be kept by way of Fixed Deposit with any scheduled nationalized bank till she attains the age of majority and said Debjani Barman when attains the age of majority shall be at liberty to approach the court for withdrawal of the same by producing relevant documents to the satisfaction of the Court. Registry is directed to do the needful in this regard. In view of the same, this application is allowed and thus disposed of.
