HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7680 of 2025 Court No. - 6 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 201 of 2022, under Sections 323, 504, 506, 307, 302, 324, 34 IPC, Police Station Kadipur, District Sultanpur. 3. The present application has been filed seeking enlargement of bail. This is the 3rd bail application. The first bail application was rejected on 09.08.2024, while doing so, it was directed that the deposition of the injured witnesses be recorded with all expedition. The second bail application was rejected on 19.03.2025, with a direction that other formal witnesses also be recorded with all expedition. 4. It is stated that all the fact witnesses have now been examined, and their statements are on record. Prima facie, the said fact witnesses have taken the name of the applicant. However, as all the fact witnesses have already been examined, and the applicant has no criminal history, there is no material on record to demonstrate that the applicant, if enlarged on bail at this stage, can affect the trial of the State. Similarly, there is no material to suggest that the applicant is at a flight risk. The applicant has been in custody since 18.05.2022. For all the reasons recorded above, the applicant is enlarged on bail. 5. Learned A.G.A. vehemently opposed the bail prayer. 6. Let the applicant Rakesh be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of the like amount each to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and Versus Counsel for Applicant(s) : Ravindra Shukla Counsel for Opposite Party(s) : G.A.
