Civil Judge Junior Division Pratapgarh And 3 Others Counsel for Petitioner :- Vijay Pathak,Rakesh Pathak Hon'ble Manish Kumar,J. Heard. Present petition has been preferred with the following main prayer: "this Hon'ble Court may kindly be pleaded to direct to Civil Judge Junior division pratapgarh to decide the Interim relief application within time specified by this court as far as earliest possible in the interest of justice." Learned counsel for the applicant has submitted that the interim relief application has been filed on 21.01.2025, which is still pending and the respondents are creating hindrance in the peaceful possession of the petitioners. On being specifically asked from learned counsel for the petitioners that whether petitioners have preferred any application for early disposal of the proceedings before the Court concerned, it has been replied that no such application has been preferred before the Court concerned and petitioners have approached this Court directly for deciding the interim relief application expeditiously. At this stage, learned counsel for the petitioners has submitted that present petition may be disposed of with a liberty to the petitioners to move an urgency application for early disposal of the interim relief application before the Court concerned and if any such application is preferred by the petitioners the same may be decided by the respondent within the stipulated time fix by this Court. Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioners. On the request of learned counsel for the petitioners and without entering into the merit of the case, the present petition is disposed of with liberty to the petitioners to move an urgency application for early disposal of interim relief application dated 21.01.2025, which is pending before the court concerned. If any such application is preferred, it is expected that respondent shall decide the urgency application preferred by the petitioners expeditiously in accordance with law, after giving opportunity of hearing to the parties concerned and without providing any unnecessary adjournment to either of the parties.
