Neutral Citation No. - 2025:AHC-LKO:48468 Court No. - 6 Case :- WRIT - C No. - 7922 of 2025 Petitioner :- Bajrang Bali And 17 Others Respondent :- State Of U.P. Thru. Secy. Deptt. Of Housing And Urban Planning Lko. And 7 Others Counsel for Petitioner :- Sunil Kumar Mishra,Ram Shubham Counsel for Respondent :- C.S.C.,Ratnesh Chandra Hon'ble Pankaj Bhatia,J. 1. Heard learned counsel for the petitioners and Shri Ratnesh Chandra, learned counsel for the respondents. 2. The present petition has been filed challenging the orders of demolition passed against the petitioners on 13.04.2023, the order of dismissal of appeal passed on 24.08.2023 and is revisional order passed on 16.07.2025 and consequential notice dated 23.07.2025, directing that in case the petitioners do not remove the offending construction themselves, the force will be used to demolish the same. 3. The main contention of learned counsel for the petitioners is that, the petitioners had moved a compounding application seeking to get the construction compounded, which application is pending before the respondent- authorities and no order has been passed thereupon. 4. Considering the fact that it is admitted that a compounding application has been filed and the same has not been disposed of, present writ petition is disposed of directing the respondent- authorities to pass order on the compounding application filed by the petitioners in accordance with law with all expedition. The order passed on compounding application shall supersede the two orders of demolition, as impugned in the present petition. 5. It is made clear that till disposal of the compounding application, no step for demolition shall take place.
