GP FOR SOCIAL WELFARE The Court made the following: :: ORDER :: The above writ petition is filed to declare the inaction of respondent authorities in considering the representation dated 17.12.2024 (Ex.P1) made by the petitioners seeking appointment of Muthavallis for Sunni Mosque, Holagunda Village and Mandal, is illegal and arbitrary. 2. Heard Smt. Marella Radha, learned counsel for the petitioners and Sri Shaik Khaja Basha, learned Standing Counsel appeared for respondents 2 & 3. SRS,J W.P.No.11656 of 2025 3. Learned counsel for the petitioners would submit that the petitioners’ grandfather was recorded as Muthavalli for Sunni Masque, Holagunda Village and Mandal. As per the Gazette, after the death of the petitioners’ grandfather, one Sri Mulla Abdul Aziz Sab and his two sons namely Mulla Adbul Rajak Sab and Mulla Lukman Sab assumed the responsibilities of the institution. Sri Mulla Abdul Rajak Sab died on 21.05.1991 and Sri Mulla Lukman Sab on 10.11.1998. The petitioners made a representation dated 17.12.2024 (Ex.P1). However, the representation has not been considered by respondent No.2. 4. Sri Shaik Khaja Basha, learned Standing Counsel would submit that the representation was not made in accordance with the Waqf Rules, 2023. Learned counsel would also submit that the respondent No.2 will consider the representation made by the petitioners and pass appropriate orders. 5. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel, directing the learned respondent No.2 to consider the representation dated 17.12.2024 (Ex.P1) made by the petitioners and pass appropriate orders, strictly as per the Waqf Rules, 2023, as expeditiously as possible. No order as to costs.
