HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 4882 of 2025 Court No. - 7 HON'BLE JASPREET SINGH, J.
1. Heard Shri Paras Pradhan, Advocate, holding brief for Shri Ashish Saxena, learned counsel for the petitioner.
2. Learned counsel for the petitioner, after arguing at some length, submits that, at this stage, since the prayer concerns the expedition of an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908, filed in Regular Suit No. 92 of 2024, and the Court concerned is presently vacant, he does not wish to press the petition. However, he prays for liberty to move an appropriate application for transfer of the said suit before a working Court, where he would move a fresh application seeking early disposal of the injunction application.
3. This Court, without entering into the merits of the case, is of the opinion that no gainful purpose would be served in keeping the writ petition pending. Accordingly, the petition is disposed of with liberty as prayed for by the learned counsel for the petitioner.
