By means of the instant petition the petitioner seeks a direction for expediting the Regular Suit No. 82 of 2011 pending before the Additional Civil Judge(Junior Division), court no. 33, Lucknow. Having heard the aforesaid plea raised on behalf of the petitioner and from perusal of the material on record including the extract of the order-sheet which have been brought on record as Annexure 4 it reveals that the parties have already put in appearance in the year 2013 and issues have also been framed since then and the plaintiff has yet not filed any evidence. In view of the above, this Court is not inclined to entertain the petition leaving it open to the petitioner to move an appropriate application before the court concerned who shall consider and decide the same in accordance with law.
