Heard the learned counsel for the petitioner and the learned Standing Counsel who appears on behalf of the State-respondent nos.1, 2 and 3 and Shri Pankaj Gupta, who appears on behalf of the Opposite party no.5, the Gram Sabha. 2. This petition has been filed by the petitioner for the following main prayers:- "i) Issue a writ, order or command in the nature of Mandamus, directing the Respondent nos.1 to 4 to immediately restrain Respondent no.5 from making any illegal construction on Gata No.300 Kha, Village Barana, Tehsil Kunda, District Pratapgarh. ii) Issue a writ, order or command in the nature of Mandamus or any other appropriate writ, directing the District Authorities to remove the encroachment already made and to initiate criminal intimidation laws. iii) Issue any other writ, order or direction which the Hon'ble Court may deem just and proper in the interest of justice. iv) Allow this writ petition with costs in favour of the petitioner." 3. The allegation in the writ petition is that the Opposite party no.5-Gram Pradhan, is constructing a road over the land belonging to the petitioner that is Gata No.300 Kha situated in Village Barana, Tehsil Kunda, District Pratapgarh. 4. This writ petition is disposed of with a direction to the Respondents to construct road in the village concerned only on land belonging to the Gram Sabha by properly demarcating the same by constituting a Revenue Team consisting of the Sub-Divisional Magistrate, Kunda, District Pratapgarh, the Revenue Inspector and the Tehsildar concerned.
