PUBLIC PROSECUTOR (AP) The Court made the following: ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioner/ Accused, seeking quashment of the proceedings against him in C.C.No.225 of 2015 on the file of I Additional Judicial First Class Magistrate, Eluru for the offence punishable under Section 420 of IPC. 2 2. Heard Sri K. Ramesh Babu, learned counsel for the petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that the petition may be disposed of giving liberty to the petitioner to raise all the contentions before the Trial Court. 4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate Orders. 5. Considering the submissions made, since it s not a fit case for quashment, the petition is disposed of without causing prejudice to the rights and contentions of the petitioner. However, the petitioner is at liberty to raise all his contentions in his defence before the Trial Court. Learned Trial Judge is requested to look into the same and take appropriate decision according to law. As this crime is of the year 2013, learned Trial Judge is requested to dispose of the case as expeditiously as possible and report the progress of the case to the Registry by 01.03.2025. 6.
