1. Heard Mr. S. M. Abdullah P, learned counsel for the petitioner. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC Case No.849/2024, pending in the Court of the learned Chief Judicial Magistrate, Nagaon, Assam. 3. The petitioner, Pranjal Bora has been shown as an absconder in the Charge- Sheet alleging commission of sessions triable offences. Initially summons was issued to the petitioner, the petitioner filed application before the Trial Court seeking time to appear. The prayer of the petitioner was rejected and the learned Chief Judicial Magistrate, Nagaon directed issue of non-bailable warrant of arrest against him. 4. The petitioner submits that he is interested in facing the trial, therefore he deserves to be given adequate opportunity to that effect. 5. I have considered the submissions made by learned counsel for both the sides. 6. Since the petitioner is interested in facing the trial, he deserves to be given some opportunity to that effect. 7. Therefore, the order directing issue of non-bailable warrant of arrest against the present petitioner, Pranjal Bora by the learned Chief Judicial Magistrate, Nagaon is set aside. Page No.# 3/3
8. The petitioner is directed to appear before the learned Chief Judicial Magistrate, Nagaon on 23.07.2025, on his appearance, the petitioner, Pranjal Bora shall be released on fresh bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Nagaon. 9. The petitioner is directed appear regularly before the Trial Court on each and every date of hearing, if he fails to do so without showing sufficient satisfactory reasons, the Trial Court shall have the liberty to procure his attendance by due process of law. 10.
