1. Heard Mr. P. Hazarika, learned counsel for the petitioner. Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State.
2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Alok Das, who has been detained behind the bars since 19.05.2025 (for last 60 days) in connection with Silapathar P.S. Case No. 110/2025 under Sections 303(2)/317(2)/3(5) of BNS read with Section 51(1) of
Page No.# 2/2 the Wild Life (Protection) Act, 1972.
3. The learned counsel for the petitioner submits that the maximum statutory period of detention during investigation for offences which are involved in this case is 60 days only under Section 487 of BNS and as the petitioner has completed the said period, he is entitled to get bail in this case.
4. On the other hand, learned Additional Public Prosecutor has submitted that he has been informed by the Investigating Officer of the Silapathar P.S. Case No. 110/2025, over telephone, that the charge-sheet has not been filed in this case.
5. As the petitioner has completed maximum statutory period of detention, and as the charge-sheet has not yet been filed, he is entitled to get bail in this case.

Accordingly, the above named petitioner, is allowed to go on bail of Rs.30,000/- (Rupees Thirty Thousand) with one surety of like amount subject to the satisfaction of the learned Chief Judicial Magistrate, Dhemaji with following conditions:- (i) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts of the case before the Investigating Officer; (ii) That the petitioner shall co-operate in the investigation;
7. This bail application is accordingly disposed of.
