This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 67/2024 registered at Police Station Gorella, District : Gorella- Pendra-Marwahi for the offence punishable under Section 21, 22 (c) GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.04.03 18:02:11 +0530 2 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The prosecution story in brief, is that the Police of Police Station Gorella, District - Gorella-Pendra-Marwahi (C.G.) has received a secret information through the informant and on the basis of the such information, the Police authority has seized a total of 17 No. of Buprenorphine Injections (each 2 ml) total 34 ml and 62 No. of Avil Injections (each 10 ml) total 620 ml from the possession of the present applicant. Thereafter, the applicant was arrested and the offence was registered by the Police. 3. Learned counsel for the applicant submits that the first bail application was rejected by this Court on merits vide order dated 23/07/2024, therefore this second bail application is filed on the ground that out of 15 witnesses, the statement of only 8 witnesses have been recorded, further charge-sheet has already been filed in the present case, the applicant is in jail since 17/02/2024 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application and submits that total of 17 No. of Buprenorphine Injections (each 2 ml) total 34 ml and 62 No. of Avil Injections (each 10 ml) total 620 ml has been recovered from the possession of present applicant, which is much above the commercial quantity, as such, applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the applicant was rejected by this Court vide order dated 23/07/2024 in MCRC No. 2516 of 2024 on the ground that the contraband article seized from the possession of the applicant was much above the commercial quantity, further there appears to be no new ground. 7. Accordingly, the second bail application of the applicant- Nasreen, involved in Crime No. 67/2024 registered at Police Station Gorella, District : Gorella-Pendra-Marwahi for the offence punishable under Section 21, 22 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8.
