GP FOR SERVICES I 2 HCGR, J W.P.No.10593 of 2025 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue a writ or order or direction more particularly one in the nature of writ of mandamus to declaring the proceedings in Rc.No.2206/2024, dated 25.03.2025 issued by the 2nd Respondent/PD thereby temporary suspended the petitioner from the post of Field Assistant working at Bhupalapuram GramaPanchayath, Gurla Mandal, Vizianagaram District, without conducting proper enquiry and procedure as illegal, irregular, arbitrary, violative of the principles of natural justice, contrary to the provisions of National Rural Employment Guarantee Scheme Act, 2005 and offends Articles 14, 19, 21 and 300-A of the Constitution of India and consequently set aside the proceedings in Rc.No.2206/2024 dated 25.03.2025 issued by the 2nd respondent/PD and further direct the 2nd respondent to reinstate the petitioner into service for said post and to pass such other order or orders…” 2. Heard Sri Appavu Muniraj, learned counsel for the petitioner, learned Assistant Government Pleader for Services-I for respondent No.1 and Sri MSR Chandra Murthy, learned Standing Counsel for respondent No.2. 3. The petitioner was appointed as Field Assistant in the year 2014. On certain irregularities, he was placed under temporary suspension by proceedings dated 25.03.2025 issued by the 2nd respondent and was called upon to submit explanation. The petitioner has submitted explanation on 02.04.2025. However, the respondents have not proceeded with further enquiry. The petitioner 3 HCGR, J W.P.No.10593 of 2025 contends that in terms of Rule 13 B (5) of Field Assistants Human Resource Policy, the enquiry is supposed to be completed within 30 days from the date of suspension, as the suspension was given effect on 25.03.2025, the timelines are not being adhered to. 4. Sri MSR Chandra Murthy, learned Standing Counsel for the 2nd respondent submits that the enquiry is being proceeded with and will be shortly concluded and would seek reasonable time to complete. 5. In view of the aforesaid submissions, the Writ Petition is disposed of with a direction to the 2nd respondent to complete the enquiry, within a period of two (02) weeks from the date of receipt of copy of this order, after providing an opportunity of hearing the petitioner and pass appropriate speaking order in accordance with law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
