JUSTICE ANOOP KUMAR DHAND Order
[2025:RJ-JP:20000] (2 of 2) [CW-6521/2025] 13/05/2025
1. By way of filing this writ petition, a challenge has been led to the impugned order dated 02.04.2025 passed by the Board of Revenue (for short, ‘the Board’) by which the transfer application filed by the petitioner under Section 233 read with Section 221 of the Rajasthan Tenancy Act, 1955 for transferring the appeal No. 155/2024 pending before the Revenue Appellate Authority to some other Court has been rejected. 2. Counsel for the petitioner submits that the Appellate Court is bent upon to hear and decide the appeal expeditiously, hence the petitioner is under apprehension that the appeal would be decided against him, therefore, he approached this Court to transfer the appeal before any other Appellate Authority. 3. No such circumstances have been revealed neither before the Board nor before this Court giving rise to such apprehension in the mind of the petitioner, which requires any interference of this Court to transfer the pending appeal before any Appellate Authority. The appeal is to be decided on the basis of the merits of the matter and the material available on record.
The Board has passed reasoned cogent order, which requires no interference of this Court and I find no merit and substance in this petition and the same is hereby rejected. 4. The present writ petition stand dismissed, accordingly. 5. Stay application and all pending application(s), if any, also stand dismissed. (ANOOP KUMAR DHAND),J Ashu/9
