After arguing for a while, learned counsel for the appellant submits that appellant is not challenging the impugned judgment on merits, and all the appellant wants that the District Collector be directed to refund the excess amount deposited by him for extension of mining lease. 4. Learned State Counsel has no objection if the appeal is disposed of in terms of the prayer made by learned counsel for the appellant. 5. Accordingly, special appeal is disposed of with a direction to District Collector concerned to examine the claim of appellant for refund of excess amount, if any, deposited by the appellant for extension of mining lease, and pass necessary order as per law within a period of four months from the date of receipt of a certified copy of this order.
