CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL Present: Mr. Amit Jain, Sr. Advocate with Mr. Chetan Salathia, Advocate for the petitioner.
ANIL KSHETARPAL, J(Oral)
1. The respondents have failed to enter appearance despite receipt of notice.
2. The plaintiff assails the correctness of trial Court’s order passed on 05.05.2018 while dismissing his application for making necessary correction in the plaint, judgment and decree by incorporating the khasra numbers in order to identify the property in the judgment and decree dated
13.08.2004.
3. The trial Court has dismissed the application on the ground that the khasra numbers are neither part of the pleadings nor evidence nor
judgment, hence, the application is dismissed.
4. Learned Senior counsel for the petitioner submits that the petitioner (plaintiff) is successor in interest of late Smt. Devi Rani, who purchased two plots bearing No.18 and 19 on 05.12.1966 and 14.11.1966. The sale deeds not only refer to plot No.18 and 19 but also refer to the following khasra numbers in order to identify the location, which is as MOHD AYUBunder:- 2025.04.29 14:53 I attest to the accuracy and authenticity of this order/judgment.
CR-6649-2018 (O&M) -2- Khasra No. 66/14/1, 13/3 66/13/3
5. Subsequently, Sh. Amar Chand (defendant No.1) by virtue of the following four sale deeds sold the same property:- Remarks Khasra No. Property No./I.D. Dt. 03.02.1988 (Ann. P6) 66//13/3/3, 66/14/1/5, 13/3/9 B-26/217 137-1/2 sq. yds. Dt. 04.02.1988 (Ann. P7) 66//13/3/3, 64/14/1/5, 13/3/9 B-26/217 137-1/2 sq. yds. Dt. 05.02.1988 (Ann. P8) 66//13/3/3, 64/14/1/5, 13/3/9 B-26/217 137-1/2 sq. yds. Dt. 08.02.1988 (Ann. P9) 66//13/3, 64//14/1/5, 13/3/9 B-26/216 137-1/2 sq. yds.
6. The plaintiff while filing the suit against Sh. Amar Chand and his vendees, claimed the aforesaid property by referring to plot No.B-26/217, which was decreed on 13.08.2004, while setting aside the four sale deeds executed by Sh. Amar Chand. He submits that in order to get the entry in the revenue record, he contacted the revenue official but they refused to honour the decree on the ground that khasra numbers have not been referred to. Hence, it is prayed that the plaintiff may be permitted to refer to the khasra numbers apart from the plot number.
7. The plaintiff wishes to incorporate the following khasra numbers in the plaint as well as in the judgment and decree:- Khasra No. 66/13/3, 66/14/1, MOHD AYUB 2025.04.29 14:53 I attest to the accuracy and authenticity of this order/judgment.
CR-6649-2018 (O&M) -3- 13/3 (587 25/36 sq. yds.)
8. The claim of the plaintiff appears to be genuine because her predecessor purchased the property while making reference to the plot numbers as well as khasra numbers. She has purchased two plots; total measuring little more than 587 sq. yards. The decree passed in favour of the plaintiff is also with regard to the aforesaid parcel of land.
9. Hence, the impugned order is set aside and the revision petition is allowed.
10. The trial Court is directed to prepare amended decree.
11. All the pending miscellaneous applications, if any, are also
disposed of. April 25th, 2025
