Learned Standing counsel has submitted that the interim order dated 24.01.2024 passed by the writ court has been complied with as the arrears of salary have been paid to the applicants, for the period as claimed. Learned counsel for the applicants has very fairly submitted that the interim order dated 24.01.2024 passed by the writ court has been complied with but the applicant nos. 5 & 6 have not been paid arrears of salary since November, 2023 which have been paid to the other applicants otherwise for all practical purposes, the present contempt application has become infructuous and the same may be dismissed as infructuous but liberty may be given to the applicants to press the same in the pending Special Appeal as neither in the case of Vinod Kumar Srivastava vs. State of U.P. and Ors. nor in the interim order passed in the Special Appeal, there is any direction for payment of arrears of salary. In view of above, the present contempt application is dismissed as infructuous with liberty to the applicants to raise their grievance in the pending Special Appeal. Notice, if any stands discharged.
