The petitioner/accused, who has been charge- sheeted for offences punishable under Sections 498A, 323, 504, 506, and 34 of the Indian Penal Code, 1860, has approached this Court seeking relief. - 3 - NC: 2025:KHC:9500 CRL.P No. 1584 of 2025 3. The prosecution alleges that the petitioner/accused, who is the husband of the defacto complainant, subjected her to mental and physical cruelty and also abused and threatened her with dire consequences. 4. The petitioner and respondent No.2 appeared before the Court via video conferencing and stated that they have amicably resolved their dispute. As per the terms of the settlement, their marriage has been dissolved, and the defacto complainant has no objection to the quashing of the impugned proceedings. 5. Their statements are placed on record. 6. Although the alleged offences are cognizable and non-compoundable, given that the parties have resolved their dispute amicably, subjecting the petitioner to trial would serve no purpose. Since the probability of conviction is remote and bleak in light of the settlement, the continuation of criminal proceedings would amount to an abuse of the process of law. ORDER i.
