Kalita, the learned counsel appearing on behalf of the petitioner. 2. Mr. P. Sarma, the learned Standing Counsel appears on behalf of the respondent Nos. 1, 2, 4 and 5 and Ms. U. Das, the learned Additional Senior Government Advocate appears on behalf of the respondent No. 3. 3. The petitioner herein has approached this Court on an apprehension that the petitioner would not be granted the settlement in respect to Sengajan Minmahal in spite of the fact that the petitioner is eligible and is the highest bidder as per the comparative statement prepared by the District Commissioner. Page No.# 3/3 4. Mr. P. Sarma, the learned Standing Counsel appearing on behalf of the Respondent Authorities submitted that in terms with the Assam Fishery Rules, 1953, the District Commissioner has to forward all the documents to the respondent Fishery Department and the Fishery Department thereupon would issue the said settlement. The said aspect is presently under consideration of the Fishery Department. 5. Taking into account the above, the apprehension on the basis of which the petitioner has approached this Court is unfounded, for which, the instant writ petition stands closed. 6. It is observed that in the event, if the petitioner is aggrieved by the decision taken by the Fishery Department of the Government of Assam in respect to the tender so submitted pertaining to Sengajan Minmahal, the petitioner would be at liberty to approach again, if so advised.
