Heard Sri Ajey Singh, learned counsel for the petitioner and Sri G.D. Bhatt, learned AGA for the State-opposite parties no.1, 2 & 3. 2. In view of the order proposed to be passed, notice to opposite party no.4 is dispensed with. 3. By means of this petition, the petitioner has prayed following main reliefs:- "[I] Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties specially opposite party No. 4 not to create any hindrance in peaceful living of the petitioner, in the interest of justice. [II] Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties No. 2 & 3 to ensure the lodging of first information report of the petitioner against opposite party No. 4 and six other individuals, in the interest of justice." 4. Sri G.D. Bhatt, learned AGA, has produced instructions letter dated 14.08.2025 provided by Sri Ayodhya Singh, Sub Inspector, Police Station- Ramgaon, District- Bahraich addressing to the Government Advocate of this Court, the same is taken on record. 5. Vide para-2 of the aforesaid instructions letter, it has been indicated that son of the present petitioner Shahabuddin and others are named Versus Counsel for Petitioner(s) : Ajey Singh Counsel for Respondent(s) : G.A. Ameenuddeen .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Home Lko. And 3 Others .....Respondent(s) accused in Case Crime No.260 of 2025, under Sections 191(2), 191(3), 109, 115(2) & 140(1) of B.N.S., Police Station- Ramgaon, District- Bahraich. Named accused persons, namely, Shahabuddin, Anas, Jeeshan, Ismail Ansari, Aftab, Jaman Ansari, Jaid Khan and Mohd. Kaif have been arrested. The police/ Investigating Officer is not harassing the present petitioner in any manner whatsoever, so the prayers of the writ petition are misconceived 6. Having considered the aforesaid facts and circumstances so indicated in the instructions letter dated 14.08.2025, we do not find any plausible reason or purpose to keep this petition pending any longer. Accordingly, the writ petition is consigned to records. 7. However, the Investigating Officer concerned shall conduct and conclude the investigation strictly in accordance with law and also the procedure so prescribed.
