Petitioner is apprehending his arrest in connection with C.P. (Excise) Case No. 23 of 2021, for the offence registered under Sections 47 (a) of the Excise Act. 3. The learned Counsel for the petitioner submits that the petitioner has not committed any offence as alleged in the F.I.R. He has been falsely implicated in this case due to grudge and ill-will. Nothing has been recovered from the house of this petitioner and there is no independent witness in this case, only home-guard personnel made seizure witness. Hence, he may be given the privilege of anticipatory bail. 4. Learned A.P.P. opposed the prayer for anticipatory bail. 2 5. Having regard to the facts of the case and looking to the allegation made against the petitioner, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court- below within a period of four weeks from today and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Bokaro in connection with C.P. (Excise) Case No. 23 of 2021, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 6. It is made clear that the petitioner shall cooperate in the investigation/trial and if the petitioner will not cooperate in the investigation/trial, the State would be at liberty to take appropriate action.
