Vakalatnama filed by Sri Surendra Kumar Yadav along with short counter affidavit is taken on record. Heard learned counsel for the applicant, learned counsel for the complainant and learned A.G.A. for the State as well as perused the record. She on her own accord went away to Surat and there they resided for one month without any objection rather on account of her free will. She has refused to undergo medical examination. He submits that the applicant is in jail since 20.04.2025. Learned A.G.A. has opposed the bail prayer however, learned counsel for the complainant has no objection in case the applicant is granted bail. Learned A.G.A. submits that victim is minor and consent of the victim is meaningless. On due consideration to the submissions advanced, perusal of the record as also the fact that the applicant is languishing in jail since 20.04.2025 having no criminal history, statement of the victim under Sections 180 & 183 BNSS, victim has refused to undergo medical examination, no radio-logical examination of the victim has been conducted by the prosecution despite several orders of this Court coupled with the fact that affidavit filed by the complainant denying the prosecution case and without expressing any opinion on merits of the case, I find it to be a fit case for enlarging the applicant on bail. Accordingly, the bail application is allowed. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (v) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 229-A of the Indian Panel Code (now Section 269 of BNS).
