Mr. Devang Dobhal, Advocate, for the petitioner. Mr. Narayan Datt, Standing Counsel, for the State. (2) Petitioner is serving as Driver with Tehsildar, Sadar, Dehradun on daily wages since 2017. By means of this writ petition, petitioner has sought the following reliefs: “i) Issue a writ, order or direction in the nature of Mandamus directing and commanding the respondents to consider the case of the petitioner for the regularization on the post of driver in the office of the respondent no. 5. ii) Issue a writ, order or direction in the nature of Mandamus directing and commanding the respondents to consider the case of the petitioner for the payment of minimum pay scale RS. 5200-20200 with grade pay of RS. 2,000/ - to the petitioner as being paid to regular employee working on the post of driver on the principal of equal pay and equal work. iii) Issue a writ, order or direction in the nature of Mandamus directing and commanding the respondents to pay the balance amount from the month of February 2023 till today @ 555/ - per day. iv) Issue a writ, Rule or direction in the nature of Mandamus directing and commanding the respondents not to show any displeasure towards the petitioner for approaching this Hon’ble Court by way of altering service condition and depriving him from legitimate and law full claim.” 2025:UHC:10099 (3) Learned Counsel for the petitioner relies upon the law declared by Hon’ble Supreme Court, which provides that after rendering sufficiently long period of service, a daily wage employee can claim m inimum of pay scale. He further submits that petitioner has made a representation to the District Magistrate, Dehradun on 19.10.2023, who may be directed to take decision thereupon. (4) Learned State Counsel submits that he has no objection if writ petition is disposed of in terms of prayer made by learned Counsel for the petitioner. (5) Writ petition is, accordingly, disposed of with a direction to the District Magistrate, Dehradun to take decision on petitioner’s representation, as per law, within ten weeks from the date of presentation of certified copy of this order.
