Heard the parties.
The petitioner has been made accused in connection with Madhuban P.S. Case No.03 of 2025 corresponding to S.T. Case No.222 of 2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 324(5), 326 of the B.N.S., 2023 and 3/4 of Prevention of Damage of Public Property Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner being member of an unlawful assembly torched the office of AJSU Party. It is submitted that the allegation against the petitioner is false. It is next submitted that because of political rivalry, the petitioner has falsely been implicated in this case. It is next submitted that vide order dated 01.05.2025 in Cr.M.P. No.1067 of 2025, the FIR in connection with this case has been quashed and set aside qua the co-accused persons; who approached this Court, as the FIR of this case is the second FIR in respect of which earlier Madhuban P.S. Case No.01 of 2025 and Madhuban P.S. Case No.02 of 2025 have been registered. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or the witnesses during the trial of the case. It is lastly
submitted that the petitioner has been in custody since 05.03.2025 as is evident from Para-01 of this bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Dhanbad in connection with Madhuban P.S. Case No.03 of 2025 corresponding to S.T. Case No.222 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number and will not annoy or disturb the informant or the witnesses during the trial of the case.
