The applicant has preferred this First Bail Application under Section 483 of the B.N.S.S. in connection with Crime No. 592/2024, registered at Police Station Balco Nagar, District – Korba (C.G.) for the offence punishable under Sections 191,296,115(2),351(2),140(3),109(1) & 3(5) of the Bhartiya Nyaya Sanhita, 2023. The prosecution case, in brief is that on 01.11.24 the complainant namely Govind Singh has lodged written report before police station Balco Nagar, District Korba (C.G.) against Sandeep Chouhan and other co-accused person stating that they have assaulted his brother namely Vinod Singh @ Chanakya with the help of hand and Talwar due to previous enmity thereafter police investigated the matter and on the basis of memorandum of co- accused person the present applicant has been implicated in this case. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant is young boy aged about 23 years and at the time of incident he was not present on the spot. He further submits that applicant has not assaulted the brother of the complainant and no article has been seized from the possession of the applicant. He further submits that applicant has no previous criminal antecedents and he is in jail since 10.01.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application. 5. I have heard learned counsel for the parties and perused the material available on record. 6. From perusal of the case diary, it transpires that due to the 3 assault made by the applicant, victim sustained grievous injuries on his head and as per the query report the injury was found to be dangerous to life and injured was also referred to higher center for neurological examination. Thus, looking to the facts and circumstances of the case and the nature and gravity of the offence, present is not a case to release the applicant on bail. Therefore, the bail application filed by the applicant/accused – Dinesh Chouhan involved in Crime No. 592/2024, registered at Police Station Balco Nagar, District – Korba (C.G.) for the offence punishable under Sections 191,296,115(2),351(2),140(3),109(1) & 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 7. Needless to say that the trial Court concerned, is at liberty to proceed and conclude the trial expeditiously. 8.
