JUSTICE A.GUNESHWAR SHARMA 8.7.2025 Present Mr.M.Gunedhor, learned counsel for the petitioners and Mr.Y.Ashang, learned PP for the State and Mr.W.Darakishwor, learned Spl PP for the CBI. Cril Petn No.38 of 2023 is an application for quashing of FIR and Charge-sheet submitted against the petitioner. It is the case of the petitioner that against the State Police Forces, State Government has granted prosecution sanction whereas co-accused Central Security Agency, Union Government has denied sanction. Since similar matter having same question as to whether only State Forces is to be prosecuted is pending before the Division Bench and this Court is not passing any order on merit. M.C (Cril Petn) No.43 of 2024 has been filed by the petitioners therein submitting that during pendency of the present FIR case against them their promotion has not been considered by the State Authority. It is submitted that direction be issued to the State respondents for consideration of their promotion during pendency of the Cril Petition No.38 of 2023. This Court has perused the contents of the application. It will not be proper for the Criminal Court to direct the respondents to consider promotion for the petitioner during pendency of the FIR cases against them. However, in the present case, trial against the petitioner cannot be proceeded due to pendency of the present criminal petition and also in absence of any sanction by the Central Government against the Central Security Personnel. It would suffice, if direction is issued to the State respondents to consider case of the petitioners for promotion to the next higher post as per Rule, notwithstanding pendency of FIR against them. With this observation, MC (Cril Petn) No.43 of 2024 is disposed of. List the remaining matter on 8.8.2025.
