Suresh Kumar Singh (Husband) Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Lko And 6 Others Counsel for Petitioner :- Satyendra Nath Pandey,Abhishek Dubey Counsel for Respondent :- G.A. Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Satyendra Nath Pandey, the learned counsel for the petitioner, the learned A.G.A. appearing on behalf of the State and perused the records.
2. The instant habeas corpus petition has been filed by the applicant seeking a direction to the opposite parties no.6 and 7 to produce the detenue before the Court.
3. Smt. Poonam Singh/the alleged detenue has been produced in this court by Sub Inspector Sri Murlidhar Mishra and lady Constable Ms. Khushbu Devi, Police Station Alambagh, Lucknow. Smt. Poonam Singh stated that this petition has been filed by Sri Suresh Kumar Singh, who is her husband alleging that she has been illegally detained by the opposite party nos.6 and 7 but this allegation is incorrect. After her relation with her husband turned sour, she has left his company and she is residing independently at New Delhi and earning and maintaining herself. She has categorically stated that she has not been illegally detained by any person.
4. In view of the aforesaid statement made by the alleged detenue, there appears to be no force in the petition seeking a writ of habeas corpus. The petition is dismissed accordingly. .
