The petitioner is apprehending his arrest in connection with Nagar Untari P.S. Case No.122 of 2023 for the alleged offences registered under Sections 379, 414, 34 of Indian Penal Code, pending in the Court of learned Additional Chief Judicial Magistrate, Nagar Untari at Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner is the owner of the tailor. He submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.9 of the petition. He further submits that allegations are made that 20 tons of coal was loaded in the said tailor. 4. Learned counsel appearing for the State opposes the prayer and submits that the petitioner is not cooperating in the 2025:JHHC:24689 --2-- A.B.A. No. 4629 of 2025 investigation. 5. Considering that the petitioner is the owner of the tailor and notice under Section 41A of Cr.P.C. has been issued against the petitioner and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
