Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer for expeditious disposal of application under Section 25(2) of Protection of Women from Domestic Violence Act, 2025 in Criminal Misc. Case No. 212 of 2021; Amzad Ali Vs. Ruksaar Khatoon and another which is pending before the learned Civil Judge (JD)/FTC/Domestic Violence Act, Sultanpur and in meantime the recovery proceeding stayed against the petitioner in Crl. Misc. Case No. 129 of 2021. Learned counsel appearing for the applicant submits that the matter pertains to the year 2011, but even after passing of four years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the learned trial court concerned is directed to consider and decide the application under Section 25(2) of Protection of Women from Domestic Violence Act, Versus Counsel for Applicant(s) : Ravindra Shukla Counsel for Opposite Party(s) : G.A.
