Forest Corporation Lko. Counsel for Applicant :- Pramod Kumar Singh,Himanshu Singh Hon'ble Manish Kumar,J. Heard. The present contempt application has been preferred for alleged non compliance of the order dated 30.04.2025 passed in Writ A No. 4730 of 2025. The relevant extract of the interim order dated 30.04.2025 for which the non compliance has been alleged in the present application is quoted hereinbelow:- "Till the next date of listing, operation, implementation and enforcement of the orders dated 12.03.2025 & 27.03.2025 (Annexures- 1 & 2) shall be kept in abeyance, so far as the present petitioner is concerned, and the petitioner shall be paid his regular wages strictly in accordance with law." Learned counsel for the applicant has submitted that despite the interim order, the applicant has not been paid salary since the month of June till date, though he has continuously made representations to the authorities. It is further submitted that by order dated 21.07.2025, an order has been passed mentioning therein that no work was taken from the applicant in the month of May and June, 2025 so on the principle of 'No Work No Pay', the salary has not been paid and in compliance of the interim order passed by this Court, the salary since the month of April, 2025 till the applicant had worked was paid. On being asked from the learned counsel for the applicant to demonstrate that he had worked in the months of May, June and July, he is unable to show any document. It is further inquired whether he has challenged the order dated 21.07.2025, he has replied that the same has not been challenged. It is further inquired as to what are those orders dated 12.03.2025 & 27.03.2025, it has been informed that these are the orders for employment of Class-IV staff including the Cooks through Outsourcing. It has been asked from the learned counsel for the applicant as to whether any person has been employed through Outsourcing in his place, he has replied that no one is employed through Outsourcing in his place. In view of the facts and circumstances mentioned above, no contempt is made out as this Court by its interim order dated 30.04.2025 has only kept the implementation and enforcement of orders dated 12.03.2025 & 27.03.2025 in abeyance and directed that the applicant shall be paid his regular wages strictly in accordance with law and there was no direction for continuance of the applicant in service, hence the present contempt application is dismissed.
