Heard learned counsel for the applicant and learned AGA for the State and perused the record. 2. By means of instant application, the applicant has impeached the order dated 06.03.2025 passed by the C.J.M., Ayodhya in Misc. Case No. 1546 of 2023 under Section 156(3) CrPC, P.S.- Kumarganj, District-Ayodhya. The order dated 06.03.2025 reads as under:- " पपश हहआ। आवपदन पर बल दपनप हपतत ककई उपसससत नहह हह। बबर- बबर पतकबर करबयप जबनप पर भभ आवपदक कक ओर सप ककई उपसससत नहह हह। आवपदक कक असनतम अवसर भभ ददयब जब चतकब हह। पबसरनब- पत ददनबनक 22.11.2023 सप लसमबत हह। ऐसप पबसरनब- पतत कक ततकबल दनसतबररत दकयप जबनप हपतत मबननभय उचच नयबयबलय दबरब दवशपष रप सप दनदरदशत दकयब गयब हह। आवपदक कक ओर सप ककई उपसससत नहह हह तसब ममकब हपतत पबसरनब- पत ददयब गयब हह। आवपदक कक लगबतबर अनतपसससदत वव पबसरनब- पत कक पबचभनतब कक ददषगत रखतप हहए ममकब पबसरनब- पत दनरसत दकयब जबतब हह तसब पबसरनब- पत अनतगरत धबरब 156 (3) द०प०सन० आवपदक कक लगबतबर अनतपसससदत व बल न ददयप जबनप कप कबरण दनरसत दकयब जबतब हह। पतबवलभ दवधध अनतसबर दबधखल अदभलपखबगबर हक।" 3. For the purposes of causing interference in the matter, this Court considered the following facts:- (i) Admittedly, a civil suit i.e. Regular Suit No. 159 of 2023 (Harinath Singh vs. State of U.P.) was/is pending with regard to property in issue i.e. Gata No. 81/0560 hect situated in Village- Isauli Bhari, Pargana-Khandasa, Tehsil-Milkipur, District- Ayodhya. (ii) Another proceeding was also pending before the Consolidation Officer, Milkipur, Ayodhya, at the time of filing of Application under Section 156(3) CrPC, which has been rejected vide impugned order dated 06.03.2025, quoted above. (iii) According to the application under Section 156(3) CrPC, the opposite parties therein as also herein demolished the old house situated over the Gata No. 81, with regard to which, civil suit is pending. (iv) In the civil suit whether any order of temporary injunction has been passed is not clear from the record. (v) Report of the Lekhpal dated 30.05.2023, annexed at page No. 24 of the paper book also indicates the aforesaid facts related to pending civil suit. (vi) To establish the fact that old house situated over Gata No. 81, which is in issue of the regular suit, no document has been placed on record. (vii) The copy of the order sheet of the case in which impugned order has been passed indicates that application under Section 156(3) CrPC, which has been rejected by the impugned order dated 06.03.2025, was filed on 22.11.2023 and thereafter, in the case dates were fixed on the issue related to submission of Police report and on 06.01.2025 the case was posted to 10.01.2025 for hearing and on 10.01.2025 the applicant failed to appear in the case and in the interest of justice, the case was adjourned to 13.01.2025 providing last opportunity to the applicant and thereafter on 13.01.2025 again the applicant did not appear and the Magistrate again in the interest of justice, fixed the case for 21.01.2025, the order sheet of 21.01.2025 has not placed on record, which ought to be. The order sheet of 11.02.2025 further indicates that on this date, the Presiding Officer was on leave and the case was fixed for 18.02.2025 and again the applicant failed to appear in the case and subsequently on 25.02.2025 again the applicant failed to appear before the Court. 4. Upon due consideration of aforesaid, this Court finds that no interference is required in the matter. 5. Accordingly, the application is dismissed.
