01. In the instant petition, the petitioner has invoked the jurisdiction of this Court under Article 226 of the Constitution of India seeking a direction upon the respondents to issue Fair Price Shop License in favour of the petitioner at Mehra Lah, Tehsil Thanamandi, District Rajouri. He further seeks a direction upon the respondents to decide the representation of the petitioner by passing a speaking order. 02. It is stated that the petitioner is a resident of Village Mehra Lah, Tehsil Thannamandi, District Rajouri and after proper evaluation and detailed survey conducted in the matter, particularly on-site, and appreciating the number of ration cards available in Village Mehra Lah, respondents issued an advertisement notice for opening a new Fair Price Shop in Jammu Division. 03. In pursuance of the said advertisement, the petitioner applied for the issuance of a Fair Price Shop License at Mehra Lah, Tehsil Thannamandi, District Rajouri. Accordingly, the approved proposal was prepared by the competent authority, wherein the name of the petitioner was recommended
and forwarded for the issuance of a Fair Price Shop License at Mehra Lah, Tehsil Thannamandi, District Rajouri. 04. It is further stated that Ration Dealers had filed a writ petition bearing WP(C) No. 1989/2019, titled Altaf Hussain and Another v/s State of J&K and Ors., against the petitioner and the same has been disposed of by this Court on 23.10.2024 with a direction to the respondents to consider the representation of the petitioners therein in WP(C) No. 1989/2019. 05. Learned counsel for the petitioner submits that the petitioner has also made a representation to the respondents which is still pending disposal before the official respondents and seeks a direction upon them to decide the same within some timeframe. 06. Learned counsel appearing for the official respondents, on the other hand, states that he is not averse to the proposition made by the learned counsel for the petitioner. 07. In view of the above, without expressing any opinion on the merits of the case, this petition is disposed of, at this stage, with a direction to the respondents to consider and decide the representation of the petitioner, dated 23.12.2024, stated to have been filed by the petitioner, by passing a speaking order within a period of one month from the date of receipt of a copy of this order.
