( Per : Hon ’ble Man oj Ku m ar Tiw ar i, J.) 1 2025:UHC:11585-DB COMMON JUDGMENT Petitioner claims to be a Dehradun based Non-Profit Organization (NGO) dedicated to care for sick, injured and voiceless animals. 2. An agreement was allegedly entered into petitioner and Nagar Palika Parishad Vikasnagar for providing shelter and care to the stray and injured cow progeny and other cattle, within municipal limits of Vikasnagar. 3. Grievance raised by the petitioner is that the amount under the agreement has not been paid. Reliance is placed upon a letter issued by the Executive Officer, Nagar Palika Parishad, Vikasnagar to Director, Animal Husbandry Department, Dehradun, Uttarakhand on 24.03.2025. The Executive Officer has mentioned in the letter that certain amount has to be paid to the petitioner. 4. Mr. Miglani, learned counsel appearing for Nagar Palika Parishad, Rishikesh in WPMB No.1055 of 2025 points out that petitioner is not maintaining proper cleanliness and hygiene. 5. Since the Executive Officer of the concerned Municipal bodies have referred the matter to Director, Animal Husbandry Department, Uttarakhand, therefore, the writ petition is disposed of with a direction to the Director, Animal Husbandry Department to examine the issue and ascertain whether petitioner is properly maintaining the cattle and is also providing proper 2 2025:UHC:11585-DB medical care to the stray cattle lodged in Gaushala of the petitioner, within four weeks. 6. It shall be open to the Director to hold a discrete inquiry regarding the functioning of petitioner. If everything is found in order, then the Director, Animal Husbandry Department, Uttarakhand shall take decision regarding release of pending dues of petitioner, as per law, within eight weeks.
