[2025:RJ-JP:10884] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No.6839/2024 Hariom Sharma S/o Shri Ramesh Sharma, R/o A-2, Veer Tejaji Nagar, Purana Bagrana Agra Road, Jaipur. ----Petitioner Versus 1. State Of Rajasthan, Through Its Principal Secretary, Department Of Medical And Health Govt. Of Rajasthan, Secretariat, Jaipur. 2. The Director, Mobile Medical Surgical Unit, Swasthya Bhawan, Jaipur. 3. The Superintendent, City Hospital/satellite Hospital, M.d. Road, Jaipur. ----Respondents For Petitioner(s) : Mr. Mirza Faisal Baig For Respondent(s) : Mr. Archit Bohra, Addl. GC JUSTICE ANOOP KUMAR DHAND Order 10/03/2025 1. By way of filing this writ petition, the petitioner is seeking directions against the respondents to not to replace his service from another set of contractual employees to discharge the work of ward boy/work assigned to the petitioner. 2. At the outset, learned counsel for the State-respondents submits that the tender providing contractual services to the petitioner through agency has expired on 31.03.2024 that is why the services of the petitioner were discontinued by the placement agency. Learned counsel submits that, subsequent to the above situation, the State Government has not made any budget provision for the project in question for the Financial Year 2024- [2025:RJ-JP:10884] (2 of 2) [CW-6839/2024] 25. Learned counsel states that the State Government would not engage another set of contractual employees by replacing services of the petitioner, hence under these circumstances, no cause of action survives with the petitioner to continue with this petition and the petition is liable to be rejected. 3. Considering the arguments put forward by learned counsel for the State-respondents and looking to the fact that the State Government has not provided any budget for the project in question for the Financial Year 2024-25 and also looking to the fact that counsel for the State-respondents has made a statement before this Court that the State would not re-engage/re-employ another set of contractual employees in place of the petitioner. Hence, under these circumstances, this writ petition does not survive and is liable to be rejected on this count alone. 4. Accordingly, the writ petition stands dismissed. Stay application as well as all applications (pending, if any) also stand dismissed. (ANOOP KUMAR DHAND),J Karan/263
