Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. Present petition has been filed for the following relief: "i. Issue writ, order or direction in the nature Mandamus thereby commanding the Opposite Party No.5 to 8 to get remove the illegal encroachment/possession Khata No.203, Gata No.164 situated at Village-Jafarpur (Jafrapur), Tehsil- Jaisinghpur, District-Sultanpur, which are recorded as Pond Land in the Revenue Record with immediate effect." 3. Leaned Standing Counsel, based upon instructions, states that six proceedings were initiated for removal of the unauthorized encroachers; in the two such proceedings which were concluded, appeals have been filed; in respect of two other cases, recall application has been filed and in respect of balance two cases, steps for initiation of proceedings are undergoing. 4. Learned counsel for the petitioner states that one of the recall applications has already been decided. 5. In view of the said statement, present petition is disposed off with direction to the appellate authority to conclude the pending appeals. 6. Further, the authority concerned is directed to decide the pending recall application in one of the cases and with regard to the two cases which are yet to be filed, the authority concerned shall take steps for initiating the proceedings and conclusion thereof within the time prescribed in the statute.
