NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India seeking the following reliefs: “(i) Direct the respondent to grant retrospective promotion to the petitioner to the post of Assistant Registrar with effect from 07.06.2022 for the purpose of granting notional benefits by issuing a writ of mandamus. (ii) Direct the respondent to consider the representations dated 11.10.2023 vide Annexure-P and 09.05.2022 vide Annexure-Q made by the petitioner by issuing a writ of mandamus.” 2. The case of the petitioner is that she was appointed as a Junior Assistant in the respondent – University on 25.05.1992. Thereafter, she was promoted to the post of Superintendent. As per the Bangalore University Statute, the minimum qualification required for the post of Assistant Registrar is that, one should be a graduate with good academic record and must have administrative experience of not less than five years. - 3 - HC-KAR NC: 2025:KHC:19977 WP No. 4234 of 2024 Since the petitioner fulfils all the eligibility criteria, she is eligible to be promoted as Assistant Registrar. But the respondent promoted one N.Sunanda, who did not possess the required degree qualification but had only completed SSLC and had obtained Masters Degree through distance education course as Assistant Registrar on 07.06.2022. The petitioner is fully qualified to be promoted as Assistant Registrar from 07.06.2022. Being aggrieved by the same, the petitioner approached this Court by filing a writ petition in W.P.No.12146/2022. This Court, by order dated 09.03.2023 allowed the writ petition and set aside the appointment order dated 07.06.2022, promoting one N.Sunanda as Assistant Registrar and directed the University to complete the entire process of reconsideration within four weeks from the date of receipt of the order. Thereafter, the petitioner’s case has been considered and she has been promoted as Assistant Registrar by order dated 07.06.2023. - 4 - HC-KAR NC: 2025:KHC:19977 WP No. 4234 of 2024 3. The learned counsel for the petitioner submits that when N.Sunanda was promoted on 07.06.2022, the petitioner was eligible to be promoted to the post of Assistant Registrar, hence, without any reason the petitioner has been denied promotion. On 07.06.2022 itself she was eligible and she is entitled for all the notional benefits from 07.06.2022. Therefore, she submitted a representation vide Annexure-P dated 11.10.2023. In support of his submission, he has relied on the judgment of the Apex Court in SLP (C) No.30700/2024 dated 02.05.2025. Since the promotion of the petitioner to the post of Assistant Registrar has been denied by the respondent, it is not the fault of the petitioner. Therefore, she is entitled for notional benefits from 07.06.2022. Hence, she submitted representation dated 11.10.2023 vide Annexure-P. The learned counsel appearing for the respondent submits that the representation submitted by the petitioner would be considered in accordance with law. 5. In view of the above, without expressing any opinion on the merits of the case, the respondent is directed to consider the representation submitted by the petitioner dated 11.10.2023 vide Annexure-P, as expeditiously as possible, not later than two weeks from the date of receipt of a copy of this order.
