Heard learned counsel for the petitioner and learned State Counsel for the opposite parties. Petition has been filed challenging the order dated 14.06.2025, whereby the petitioner has been transferred from Raebareli Division (South) Sharda Nahar Raebareli to Lucknow. It has been submitted that the impugned order has been passed allegedly on the basis of a complaint made against petitioner and is, therefore, punitive in nature and not a matter of routine transfer. It is further submitted that petitioner has less than two years left to superannuate in February 2027 and therefore claims the benefit of paragraph 5(v) of the Government Order dated 06.05.2025, particularly since he is a Class III employee. In view of the submissions made by learned counsel for the petitioner, liberty is granted to petitioner to make a fresh representation before the opposite party no.2 i.e. Chief Engineer-Project (Establishment-7 Section), Department of Irrigation and Water Resources, Lucknow to consider the petitioner's grievance in the light of paragraph 5(v) of the Government Order dated 06.05.2025. In case such a representation is made within a period of three days from today along with a certified copy of this order, the same shall be considered and decided within a period of ten days thereafter. It is provided that till the decision on petitioner's representation, the impugned order dated 14.06.2025 shall remain in abeyance.
