CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER
Accused No.3 in S.C.No.3/2022 pending before the Court of III Additional District and Sessions Judge, Mysuru arising out of Crime No.70/2021 registered by Vidyaranayapura Police Station for the offences punishable under Sections 114, 115, 120B, 216A, 342, 394, 396, 399 and 449 of IPC and Sections 25, 25(1B) and 27(1) of Indian Arms Act is before this Court in this successive bail application filed under Section 439 of Cr.P.C. seeking regular bail.
2. Heard learned counsel for the parties.
3. Petitioner had earlier approached this Court in Crl.P.No.8116/2023 seeking regular bail and the said petition was dismissed by a reasoned order dated 23.09.2023 by this Court. Subsequently, the present petition is filed seeking regular bail on medical grounds. This Court, vide order dated 31.07.2024, considering the health conditions of the petitioner had granted him interim bail for a period of 30 days, operational from the forenoon of 02.08.2024 till the evening of
31.08.2024. This Court had specifically observed that petitioner

HC-KAR NC: 2025:KHC:19678 CRL.P No. 1105 of 2024 shall surrender before the jurisdictional Court on or before the evening of 31.08.2024.
4. Petitioner, who was released on interim bail on medical grounds by the aforesaid order, thereafter had failed to surrender before the trial Court as per the terms and conditions of the interim bail granted to him and efforts made to trace him had failed. This Court had therefore issued Non-bailable warrant against the petitioner on 15.04.2025 and also directed the trial Court to proceed against the solvent sureties in accordance with law. On 02.05.2025, learned Addl. SPP, on instructions, had submitted that Non-bailable warrant issued against the petitioner on 15.04.2025 could not be executed and therefore, Non-bailable warrant was re-issued to the petitioner. Subsequently, petitioner was arrested on 02.06.2025 by a team of police who had gone from Msyore to Kashmir after Non- bailable warrant was re-issued against the petitioner. Petitioner, who was arrested at Sailan Halli Surankote in Poonch District at Kashmir was subsequently brought to Mysore and he was produced before the jurisdictional Court on 04.06.2025 and has been now remanded to judicial custody.

HC-KAR NC: 2025:KHC:19678 CRL.P No. 1105 of 2024
5. On the merits of the case, petitioner's prayer for grant of regular bail was rejected by this Court by a reasoned
order in Crl.P.No.8116/2023 disposed of on 23.09.2023. Petitioner, who was released on interim bail for medical reasons, has failed to comply with the bail conditions and on the other hand, he had absconded and with great difficulties his presence has been secured and he is now remanded to judicial custody. Under these circumstances, I do not find any good ground to entertain this petition.
6. Accordingly, the petition is dismissed. SD/- (S VISHWAJITH SHETTY) JUDGE VM List No.: 1 Sl No.: 42
