1. Heard learned counsel for the petitioner and learned Standing Counsel appearing on behalf of the State Respondents. 2. This petition has been filed praying for a mandamus to be issued to the respondent nos.2 to 3 to construct chak marg only over land that has been earmarked for the same i.e. Gata No.895/0.1070 hectare in Village Raibigo, Pargana Aldemau, Tehsil Kadipur, District Sultanpur. 3. It has been submitted that the Gram Pradhan out of the election enmity with him has deliberately used a JCB machine to dig land belonging to the petitioner i.e. Gata No.894 min. 0.2810 hectare. Additionally, it has been prayed that the respondents may decide the representation of the petitioner which is pending before them. 4. Learned Standing Counsel has produced before this Court instructions sent by the Tehsildar Kadipur dated 08.08.2025, wherein it has been stated that Gata No.895/0.1070 hectare is earmarked as chak marg. Gata No.894 and Gata No.896 belong to private tenure holders. There was a dispute regarding the Pradhan using his power to take over portion of the petitioner's land. The allegation made by the Pradhan was that the petitioner has encroached upon chak marg. A revenue team was constituted and it earmarked chak marg again and re-soiling was done only on chak marg. The petitioner was advised to file an application for demarcation. The petitioner has
filed an application under Section 24. It has been registered as Case No.T-202504680404191: Tidi Ram Vs. State of U.P. and others, wherein his land was also demarcated. However, it was found that the land of the petitioner as shown in the revenue records was more than the land that was shown in the village map, and therefore, he was advised to file an application for correction of map which he has done. The application under Section 30(1) of the U.P. Revenue Code registered as Case No.T- 202504680407415 is pending disposal before the Appropriate Authority. 5.
The village map shows the land of the petitioner to be less by 0.015 hectare from the revenue record and proceedings are being undertaken under Section 30(1) of the U.P. Revenue Code for correction of map. The next date fixed in the said case is 23.08.2025. 6. This petition is disposed of with a direction to the Tehsildar to ensure that the land of the petitioner as per revenue record is maintained on the spot and the Village Pradhan is directed to construct the chak marg only over area of Gata No.895 earmarked in the village map as chak marg.
