Case No.28/2022, registered for the offence under Sections 379/414/34 of the Indian Penal Code and Section 30(ii) of Coal Mines Act, pending in the Court of the learned C.J.M., Giridih. 2. Learned counsel for the petitioner submits that the allegations are made that four motorcycles have been seized on which two quintals coal have been loaded on each of the motorcycles. He further submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 6. He also submits that co-accused persons have been granted anticipatory bail in A.B.A. Nos.7741 of 2022 and 5123 of 2024. 3. Learned counsel for the State opposed the prayer and submits that illegally the coal was being carried in the motorcycles. 4. Considering that in identical situation, co-accused persons have been granted anticipatory bail and the petitioner has got no criminal antecedent and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 5. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Giridih in connection with Bengabad P.S.
