The present application is filed with the prayer to direct to court below to decide the Criminal Case No.4029 of 2023 "State Vs. Jai Prakash Pandey & Ors." arising out of Case Crime No.198/2018 under Sections 147, 323, 325, 504 I.P.C., Police Station Munshiganj, District Amethi. 3. Learned counsel for the applicant submits that charge sheet was filed against the private respondent in F.I.R. No.198/2018 under Sections 147, 323, 325 and 504 I.P.C. and the cognizance was taken by the learned court below on 28.11.2018, thereafter, summons were issued to the accused persons but the same was not served, thereafter, bailable warrants were issued. He further submits that respondent no.2 & 3 appeared before the court below, therefore, their warrants were set aside but the respondent nos.4 & 5 are not appearing, therefore, necessary directions may be issued. 4. Learned A.G.A. oppose the prayer of the applicant and submits that applicant may move appropriate application before the trial court. 5. Considering the submissions of learned counsel for the parties, going through the contents of the application, present application is disposed of with the direction that applicant may move appropriate application before the court below and in case, any application is filed, same shall be considered and decided expeditiously in relation to ensure the presence of accused persons. 6. The Superintendent of Police, Amethi is also directed to ensure the presence of accused persons before the trial court.
