Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed seeking following relief :- "Issue a writ, order or direction in the nature of mandamus commanding the respondents not to demolish the house of the petitioner situated at Gata No. 76 at village Inayatpur, Post- Silai Badagaon, Pargana, Block and Tehsil- Milak, District Rampur illegally and without acquiring the land of the petitioner. B. Issue a writ, order or direction in the nature of mandamus commanding the respondents to make the proper demarcation of Gata No. 76 of the petitioner and Gata No.82 of the private respondents before widening the road by respondent no.5." 3. Instructions have been placed today by learned Standing Counsel which are taken on record. As per instructions, learned Standing Counsel has submitted that land of the petitioner being Gata No.76 has been excluded from acquisition as the same is not required. 4. In view of this fact, no further orders are required to be passed in this writ petition. 5. It is expected that as and when the land of petitioner will be required by the respondents - authorities, they will acquire the same, in accordance with law, and the same shall be utilized by the respondents only after providing adequate compensation of land. 6.
