Digitally signed by LAKSHMI T Location: High Court of Karnataka - 2 - NC: 2025:KHC:7274 CRL.P No. 1525 of 2025 THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition under Section 482 of BNSS, 2023 is preferred to enlarge the petitioner on anticipatory bail in a case registered in Crime No.13/2025 at Kumbalagudu Police Station, Ramanagara, for an offence punishable under Section 75 of BNS, 2023. 2. Heard both sides and perused the material on record. 3. In the complaint lodged by the victim with the Police, she has alleged that on 08.01.2025 at about 9.00 p.m., when she was standing near Gollahalli Bus Stand, the accused came on a motorcycle and in the guise of giving her drop, took her in the said motorcycle to an empty layout and touched her inappropriately making sexual advances and outraged her modesty etc. - 3 - NC: 2025:KHC:7274 CRL.P No. 1525 of 2025 4. Complaint is lodged on 11.01.2025. The learned counsel for petitioner drawing the attention of the Court to the complaint averments, contended that after the alleged incident, victim took drop from another motorcycle rider and went to her house, but till 11.01.2025, she did not inform the matter to anyone including her family members. He contended, the entire allegations are false. 5. The allegations against the petitioner have to be established in due course. The victim has stated that, due to ill-health she did not lodge the complaint immediately. This Court is not convinced with the said explanation. Complainant has not stated that the matter was informed to her family members or to the person who dropped her to the house. Petitioner has undertaken to cooperate with the investigation of the case. Hence without expressing any view on the merits of the case, relief sought by the petitioner can be granted by imposing conditions. Accordingly, the following: - 4 - NC: 2025:KHC:7274 CRL.P No. 1525 of 2025 ORDER (i) Petition is allowed. (ii) Petitioner/accused in Crime No.13/2025 of Kumbalagudu Police Station, Ramanagara, shall be released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only), with one surety for the likesum. b) He shall furnish his residential address/contact number and shall inform the I.O in case of any change in the address/contact number. c) He shall cooperate with the investigation. d) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. - 5 - NC: 2025:KHC:7274 CRL.P No. 1525 of 2025 e) He shall not commit any offence. f) He shall appear before the Court on every date of hearing.
